UPAYBAZAAR Pay Rent/Education Fee Terms & Conditions
Our Role: education.upaybazaar.com is providing an option to its registered users (hereinafter referred to as "User", "you" or "your") for making their house/ office rental, Security deposits, Token payments and also education fee through its Website and Mobile App (hereinafter referred to as Platform) to their respective landlords or lessors or institutions ("Beneficiary"). By using this Platform, the User hereby confirms to accept these Terms, terms of use policy and privacy policy of education.upaybazaar.com . By using this Platform, the User confirms that there is a valid lessee and lessor or payer and payee (Education) relationship between the User and the Beneficiary, and the amount being transferred through the Platform is representing the actual value as per the rental agreement/education/tuition receipt executed with such Beneficiary. Without prejudice to any documentation, we may have asked for in support of this arrangement, we are not required to carry out an independent verification of the validity of this relationship between you and the Beneficiary or the quantum of the rental amounts required to be paid further to the inter-se arrangement. It will be the User's responsibility to ensure authenticity of transaction and enter correct Beneficiary details. We are only providing a platform to facilitate these house rent, office rental, Security deposits, token payments etc. from the User to the Beneficiary and we are not involved in any way in the underlying transactions between the User and the Beneficiary. The User needs to comply with the relevant regulations if any related to such payments and shall be responsible for any non-compliance or defaults in such payments. We are not a financial institution and do not offer any sort of banking or related financial services, apart from the services covered by these upaybazaar Pay on credit service terms & Conditions. We may use the services of the third parties specified herein, to provide the services and process your transactions. These third-party service providers may have their own privacy policies and terms of use and we recommend that when you enter a third-party site, you review their privacy policy and terms of use. For the limited purpose of facilitating the house rent, office rental, Security deposits, Token payments and also education fee etc. from the User to the Beneficiary, we act on your authorization to make the payments to the concerned Beneficiary. For all other purposes, we and the User will be deemed to have a principal-to-principal relationship. KYC Documentation: While you will be completely responsible for proving the authenticity of the transaction, education.upaybazaar.com may ask for requisite documents or details of the User and the Beneficiary including any document to substantiate the lessor and lessee relationship between you and the Beneficiary. Example: Rental Agreement, PAN Card, Aadhar Card, rental receipts, etc. User is required to mandatorily provide PAN card details or any other documents or information pertaining to the User and/or the Beneficiary as required in accordance with the statutory and legal obligations of education.upaybazaar.com . These requirements may be updated from time to time. education.upaybazaar.com use and processing of information identified under this para, belonging to the Beneficiary shall be subject to the terms specified under the Schedule A herein below. You further acknowledge and understand that, in order to process your rent payment, education.upaybazaar.com is required to share your details/information, as specified above, with the partner(s), Beneficiary, and/or any other third-party. This may include, but is not limited to, validating your details, checking your credit history/ score, and other related purposes. You hereby give your free, specific, and informed consent to education.upaybazaar.com for the disclosure and sharing of your details/ information with such partner(s), Beneficiary, and/or any other third-party, as necessary for these purposes. education.upaybazaar.com shall not be liable for any consequences arising from such disclosure. Authorization: By initiating this transaction on the Platform, you authorize us, as your pure agent, to hold, receive and disburse funds in accordance with your payment instructions to the designated bank account of the Beneficiary. Your authorization permits us to charge the mentioned amount to your Bank Account, Credit Card, UPI Account, Debit Card, Payment Wallets or any other Payment Instruments as may be enabled on our Platform from time to time for remitting the amount to the designated bank account of the Beneficiary. When you instruct us to pay the Beneficiary, you authorize and order us, as your pure agent, to commit your payment (less any applicable fees, Service Charges, or other amounts that we may collect under this Agreement) to such person. In case, the transaction is not processed due to incomplete details being provided by you then we shall refund the amount to you after deducting any applicable Service Charges, Transaction fees, and penalty amount. Transaction terms: Any transaction initiated from your registered account with us shall be presumed to have been undertaken under your instructions and order, and you will solely be responsible for the same. Further, you would be responsible for entering the correct bank accounts details of the Beneficiary at the time of making the transaction and in no circumstances, Education.upaybazaar.com shall be held responsible for any wrongful credit due to incorrect bank details. You would be responsible for any fraudulent transactions that happens through your bank account, credit card account, etc. due to your negligence and/or as a result of providing your bank or card details to any third party or otherwise. In no circumstances, shall Education.upaybazaar.com be held responsible for any such fraudulent transactions and no refund shall be made by Education.upaybazaar.com once the money is successfully credited to the designated bank account of the Beneficiary. We may delay, suspend or reject a payment(s) transaction for any reason, including without limitation if we suspect the transaction subjects us to financial or security risk or is unauthorized, fraudulent, suspicious, unlawful, in violation of the terms of this Agreement, subject to dispute or otherwise unusual. Tax Deduction at Source: Any obligation pertaining to deduction of tax at source under the provisions of Income Tax Act, 1961, in respect of the transactions relating to payment of rent which are facilitated through Education.upaybazaar.com , shall be sole responsibility of the User to comply with, and Education.upaybazaar.com will not be obligated to comply with the said provisions on behalf of the User. Any penal consequences arising on the User on account of non-compliance with the applicable provisions relating to deduction of tax at source shall be borne by the User, and in no circumstances, Education.upaybazaar.com will be liable to indemnify the User in respect of such penal consequences. Indemnity: You agree that we are merely acting as your payment agent and that this will not make us liable or responsible for any breach of your payment obligations, any fraud, unauthorized or illegal transaction undertaken from your registered account with us. You agree not to hold UPABAZAAR responsible and/or liable for any issue or claim arising out of any dispute whatsoever between you and/or the Beneficiary and/or any financial institution. You agree to hold harmless Education.upaybazaar.com for any transactions done by you with incorrect details etc. which gets credited in any wrong account. You agree to fully indemnify and hold harmless Education.upaybazaar.com , its affiliates, and employees against any claim or action by any person or regulatory authorities. Further, Education.upaybazaar.com shall not be liable for any tax payments/implications arising out between the payer and the receiver due to the arrangement between them. Suspicious / Fraudulent transactions: The User is supposed to immediately notify us in case any suspicious/fraudulent transaction is observed by him. It is the User's responsibility to keep his financial details strictly confidential and not share them with any other person. As soon as any suspicious/fraudulent transactions get reported, we shall take the necessary measures and try to stop the same. However, we shall under no circumstances be liable for any refund, etc. to any person / Authority for such transactions if the money is credited to the designated bank account of the Beneficiary as provided by the User. Refunds: In case, Education.upaybazaar.com is not able to transfer the rent amount to the designated bank account of the Beneficiary due to any technical issues, then we shall refund the amount in the same account from which the remittance was initiated. Education.upaybazaar.com shall under no circumstances be liable to repay/refund the amount to the User once the amount has successfully been credited in the designated bank account of the Beneficiary. Chargebacks: The amount of a transaction may be charged back or reversed (a "Chargeback") from the Beneficiary if the transaction: (a) is disputed by the User, or (b) is reversed for any reason, or (c) was not authorized or we have reason to believe that the transaction was not authorized by the User, or (d) is allegedly unlawful, suspicious, or in violation of the terms of this Agreement. In such cases, the Beneficiary of the amount will immediately pay us the amount of any such Chargeback and any associated fees, fines, or penalties assessed by our associated Payment Network Gateways / Financial Institutions. The User/ Beneficiary shall assist us when requested, at their own expense, to investigate any of the disputed transactions processed through our Platform. For any such Chargebacks associated with Cards, we will assist the User/Beneficiary to contest the Chargeback with the Network or issuing banks in case the Beneficiary chooses to contest any of such Chargeback. In case of the Beneficiary's failure to timely assist us in investigating a transaction, including without limitation providing necessary documentation within 3 business days of our request, may result in an irreversible Chargeback. Any Chargeback shall be the sole responsibility of the Beneficiary and we shall not be liable in any manner whatsoever for the same. We shall not be liable for any fraudulent transactions where the OTP from the bank has been shared by the User with any third party, or where fraudulent transactions occurred due to the User's negligence. Cash back /Coin Terms & Conditions Here are the terms and conditions ("Terms") of the Cashback/Coin offered on using the Pay on Credit services on Education.upaybazaar.com . These Terms are between you and Alfastar India Finance Consultancy Private Limited (Education.upaybazaar.com ) and/or its affiliates ("Education.upaybazaar.com " or "Us") and govern our respective rights and obligations. If you sign up for a Subscription, you hereby accepting these terms, conditions, limitations and requirements. Lucky one - There will be a random user selected by Education.upaybazaar.com of all the users who all have used the Pay on Credit services on Education.upaybazaar.com platform in a particular day. Only the users who are able to see the wallet coin on the rewards page of the Education.upaybazaar.com website shall be eligible to get the reward. Limitation - A user can win a maximum of 1-5 Cashback (subject of company) in a month. Process of getting reward - The cashback reward amount shall be given as refund to the source account through which payment was made by the user at the time of using Pay on Credit services. However, it is to be noted that refund of the reward amount shall be processed once the payout to the beneficiary is successful while using the Pay on Credit services. Time taken for processing - Education.upaybazaar.com shall initiate the refund of cashback/Coin as soon as the payout of the beneficiary is successful, however it might take up to 10 working days for the amount to get credited into the source account. Termination by us - In case if Education.upaybazaar.com found anything suspicious or found someone violating the terms or conditions or any other applicable law or any other activity which is harmful in the public interest including but not limited to fraud or misuse of the services, then Education.upaybazaar.com has all the rights to cancel the Jackpot without giving prior notice. Limitation of Liability: In addition to other conditions, in no event will Education.upaybazaar.com or our directors, officers, employees, agents or other representatives be liable for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to Pay on credit subscription or Cashback rewards linked with it. All dispute shall be governed by and construed in accordance with laws of India and the competent courts in Sambhar Lake shall have exclusive jurisdiction. Schedule- A Terms of Use, for Beneficiary's Personal Data 1. Use of Beneficiary's Personal Data: “Personal Data” means personally identifiable information like name, address, age, email address and phone number, identifiers etc. As part of the services and transaction, Education.upaybazaar.com shall receive information of Beneficiary (such as Pan Card, Bank Account Details (including UPI details), Name, Date of Birth (DOB)) ("Beneficiary Data"). 2. Sharing Beneficiary Data: Education.upaybazaar.com shares the Beneficiary Data with entities responsible to conduct know-your-customer (KYC) check on the Beneficiary Data and other associated information shared by User while making payment to the Beneficiary. As on date, the Beneficiary Data is being shared with the following third-party(ies): Any other partner(s) from time to time. Education.upaybazaar.com may disclose the Beneficiary's Personal Data if Education.upaybazaar.com believes such disclosure is required to comply with statutory requirements, court orders, or directives from the competent authorities or when Education.upaybazaar.com have consent from User to share the Beneficiary Personal Data with other third-party(ies). If the User does not want Education.upaybazaar.com to share the Beneficiary Data with other companies or organizations, the User may notify Education.upaybazaar.com by emailing at support@education.upaybazaar.com . 3. Responsibility with regard to Beneficiary Data: In performance of the services as required by the User under the terms of these Terms, User hereby voluntarily agrees to share the Beneficiary Data with Education.upaybazaar.com . User acknowledges that the Beneficiary Data is received by User as a result of the legal and statutory obligations of Education.upaybazaar.com . User shall remain solely responsible and liable for the quality, contents, accuracy and correctness of the information under the Beneficiary Data. User hereby instructs Education.upaybazaar.com to process the Beneficiary Data. Education.upaybazaar.com shall not process the Beneficiary Data, other than on User's documented instructions, as provided in these Terms. Save for the third-party(ies) already consented to by User and specified under these Terms, Education.upaybazaar.com shall not appoint or authorize disclosure of Beneficiary Data, unless authorized by User. User hereby explicitly affirms and declares that User possess the complete authority to share the Beneficiary Data and other relevant information as specified above, on behalf of the Beneficiary. User fully understands that providing incorrect information, details, or facts may result in User being held liable for fraud and/or for violation of any applicable law. Education.upaybazaar.com processes, uses, reads, views and accesses the Beneficiary Data, based on the instructions issued by User from time to time. For avoidance of doubt, based on the instructions provided by User to Education.upaybazaar.com , Education.upaybazaar.com can perform the following processing activities on the Beneficiary Data: KYC Check; Data Validation; Transfer to Beneficiary as per the instructions of User; Sending reminder messages/SMS for monthly rent payments (including other services) through partners. User shall comply with the applicable law including but not limited to Information Technology Act, 2000, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, the Digital Personal Data Protection Act, 2023 and any other data protection laws that may be amended or applicable from time to time, while sharing the Beneficiary Data with Education.upaybazaar.com . User agrees and acknowledges that Education.upaybazaar.com shall at no point obtain any consent or send communication (whether written or oral) to the relevant Beneficiary, before or during the processing of Beneficiary Data by Education.upaybazaar.com .
